Yes, and it’s one of the bigger differences between Massachusetts and most other states. Massachusetts law requires a licensed real estate attorney to conduct the closing, and buyers and sellers typically each hire their own. Attorney fees generally run $800 to $1,500 per side, so factor that into your closing cost estimate alongside the usual lender and title fees.
Massachusetts charges a deed excise tax of $2.28 per $500 of the sale price, which works out to roughly $2,280 on a $500,000 home. It’s typically paid by the seller, though buyers and sellers can negotiate a different split. Barnstable County charges a higher rate to fund the Cape Cod and Islands Water Protection Fund, and Nantucket adds a 2% land bank fee that buyers pay on top of the standard tax.
Massachusetts automatically protects $125,000 of home equity from most creditors with no filing required. Homeowners who file a Declaration of Homestead can raise that protection to $1,000,000, and owners who are 62 or older or disabled can each file for a personal $1,000,000 exemption on a shared home. Homestead protection does not shield you from the mortgage you used to buy the home. It protects against unrelated creditors and judgments, not against your own lender’s normal right to foreclose if payments stop.
Yes. MassHousing, the state’s housing finance agency, offers down payment assistance up to $30,000 through a second loan paired with a MassHousing first mortgage. Borrowers can choose a 0% interest, deferred-payment option or a 15-year amortizing loan at 2% or 3% APR, depending on how much of the $30,000 they use.
