Frequently Asked Questions About Mortgages in North Carolina

Does North Carolina require an attorney at closing?

Yes. North Carolina is an “attorney state,” which means a licensed attorney has to handle the title examination, prepare the closing documents, and control the disbursement of funds. Title companies can issue title insurance, but they can’t perform those legal functions on their own, so a real estate attorney is part of essentially every North Carolina closing.

Yes. The state charges an excise tax, sometimes called a revenue stamp, of $1 for every $500 of the sale price, which comes out to about $1,000 on a $500,000 home. It’s typically paid by the seller. Seven northeastern counties — Dare, Camden, Chowan, Currituck, Pasquotank, Perquimans, and Washington — can charge an additional local land transfer tax of $1 per $100. That’s a meaningfully higher rate to be aware of if you’re buying near the Outer Banks.

North Carolina actually has two separate protections that both get called a “homestead exemption,” and they do different things. The first is a bankruptcy and creditor protection: $35,000 of home equity for most owners, $60,000 for those 65 or older under certain conditions, and it can double for married couples who jointly own the home and file bankruptcy together. The second is a property tax break, the Elderly or Disabled Property Tax Homestead Exclusion, which excludes the greater of $25,000 or half your home’s appraised value from taxation if you’re 65 or older or totally and permanently disabled and your income falls under a limit the state adjusts every year.

Yes. The NC Home Advantage Mortgage offers down payment assistance up to 3% of your loan amount as a forgivable second loan, forgiven gradually starting in year 11 and fully forgiven by year 15 as long as you don’t sell or refinance before then. First-time buyers and veterans may also qualify for the separate NC 1st Home Advantage Down Payment option, worth up to $15,000.
